General Terms & Conditions

Grants from Living Well Dying Well Trust are sums of money intended to help bring projects or ideas to life. They are financial gifts to support vital work and do not need to be repaid, unless the grant terms are not met.

We’re thrilled to support projects that come from the heart and align with our aims.
To make sure your grant application journey is as smooth and clear as possible, we’ve outlined a few terms. Some of the wording may feel formal, but it’s just here to keep things fair, transparent, and easy to navigate for everyone involved.

Depending on the size, scope and duration of funded projects, specific and bespoke terms may be incorporated into the final Grant Agreement between Living Well Dying Well Trust, hereinafter referred to as “LWDW Trust, we, us, our” and the grant applicant/recipient hereinafter referred to as “you, your”.

 

1. Grant Purpose

If a grant is awarded, we will provide the funding to support a specific project which has the purpose(s) and objective(s) in alignment with those of Living Well Dying Well Trust which will be outlined in your Project Proposal.

2. Grant Amount

If a grant is awarded, we agree to provide you with the full or a partial amount of the funds you applied for. Monies will be paid to your designated UK bank account in one or more instalments, as agreed, depending on the size of the award and the duration of the funding period.

3. Grant Funding Period

If a grant is awarded, the grant funding period shall begin on the date that the first instalment of money is made to you and will end 8 weeks after the completion of the project. You’ll need to complete all grant related activities and submit any required reports within this period. We shall keep in contact with you and remind you of submission dates.

4. General

As project leader, you must ensure that any of your team involved in the project comply with the grant terms, conditions and the agreement.

5. Reporting and Documentation 


If awarded a grant, you’ll be asked to provide a simple Project Report within 8 weeks of the completion of your project. A form will be emailed to you for this purpose. If you require the form in an alternative format, we’ll work with you to arrange the best way for you to share the information needed.

You’ll need to maintain accurate records, expense receipts and documentation related to the use of grant funds and will need to make them available to us on request.

6. Budget and Expenditure

If awarded a grant, you’ll only be able to use the grant funds for the sole purpose specified in your Grant Agreement.

You’ll agree to manage the grant funds responsibly and to expend them in accordance with the approved budget, if applicable.

Any significant budget revisions or changes in expenditure must be discussed with us first.

7. Compliance with Laws and Regulations

If awarded a grant, you agree to comply with all applicable laws, regulations, and legal requirements related to the use of grant funds, including but not limited to financial reporting, tax obligations, and record-keeping.

8. Safeguarding and Due Diligence

We take our safeguarding responsibilities seriously and are committed to protecting the wellbeing of children, young people and adults at risk who may be connected to the projects we fund.

As part of our duties as trustees and in line with Charity Commission guidance, we carry out appropriate and proportionate due diligence during our assessment and award process. This helps us ensure that funds are used for charitable purposes, are managed responsibly, and do not expose beneficiaries or the Trust to harm or undue risk.

Our checks may include, but are not limited to identity verification, review of safeguarding policies and procedures, confirmation of relevant DBS checks where appropriate, verification of bank account details, and fraud prevention and anti–money laundering checks.

We may request further information where necessary to satisfy ourselves that appropriate safeguards and financial controls are in place.

9. Intellectual Property

Any intellectual property rights arising from the activities funded by the grant shall be specified within the Grant Agreement. Ordinarily they will be owned by you. We may ask to be acknowledged as grant funders and supporters of the project. Occasionally, we may ask for the LWDW Trust name and logo to be removed from project acknowledgements, should circumstances require it. 

10. Grant Amendments and Termination

We reserve the right to amend these Grant Terms and Conditions at any time and with immediate effect.

We reserve the right to terminate the funding if a grant recipient fails to comply with the terms and conditions outlined in their Agreement or if the purpose of the grant is not fulfilled.

If awarded a grant, should the scope, direction, leadership or financing of the project change from the original application, you’ll need to advise us of these changes straight away. We may agree to the reassignment of the funding, providing it remains in alignment with Living Well Dying Well Trust’s objectives; however, we reserve the right to request full or partial repayment of funds if the new project no longer meets any or all of the eligibility criteria or objects of the charity, for which the funding was initially intended.

If, after the signing the Agreement and/or any payments are made, you decide not to go ahead with your planned project, you must inform us straight away and arrange for any funds received to date to be returned in full.

11. Publicity and Recognition

If grant funding is awarded, you agree that we may publicise and recognise the grant and our involvement in any related material, including press releases, reports, and public announcements, unless otherwise agreed upon in writing. If you share names or photographs of participants with us, please make sure they have given their consent for their name and image to be used for this purpose.

12. Use of Living Well Dying Well Trust’s branding and logo

If you’d like to use our logo on printed materials or digital platforms, such as your website, social media, or email communications to acknowledge funding from LWDW Trust, please get in touch with us first. We’ll be happy to provide permission, along with the correct logo files and simple guidance to help you use it consistently and in the right format. To ensure our branding remains clear and recognisable, the logo should always be used from the master artwork we supply, and its colours and fonts should not be altered.

13. Privacy and Data Protection

We take your privacy seriously and handle your personal information responsibly. Any data you share with us as part of your application or grant will be managed in line with our Privacy Policy and UK GDPR.

We only collect what’s needed to assess, award, and monitor grants. Your information is stored securely, kept only as long as necessary, and then safely deleted.

14. Indemnification

Grant recipients agree to indemnify and hold harmless Living Well Dying Well Trust, its officers, employees and agents from any claims, damages, or liabilities arising out of their activities related to a grant. We strongly recommend that you seek independent professional advice to ensure that you are suitably covered with appropriate insurance for the project you are undertaking. We may request evidence of your insurance cover.

15. Governing Law and Jurisdiction

Our General Terms and Conditions and the final Grant Agreement shall be governed by and construed in accordance with the laws of United Kingdom. Any disputes arising under or in connection with these shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

16. Entire Agreement

If a grant is awarded, the Grant Agreement will constitute the entire understanding between us and you, the grant recipient, regarding the grant and supersedes any prior agreement, understandings, or representations, whether written or oral, relating to the subject matter hereof.

 

Both parties will be required to sign the Agreement to signify their agreement to all clauses laid out in the Grant Agreement from the start date written at the top.
